From 1 April 2027 HSWA centres on 'critical risks'. Fatigue is not on the Schedule 1A list, so it is critical only where likely to cause death or notifiable harm. Firms of 20 or more must still manage all risks, critical first; smaller firms manage critical risks only. Some approved codes give a safe harbour; officer duties focus on governance.

Law, accounting and consulting firms in New Zealand work under no sector-specific fatigue or hours rule. The Law Society and Chartered Accountants Australia and New Zealand treat workload and wellbeing as professional-conduct and support matters - counselling, guidance, fitness to practise - not as enforceable limits on hours. New Zealand has no right to disconnect and no maximum working week, so billable-hours pressure and after-hours contact are lawful. What binds you is the Health and Safety at Work Act 2015 duty to manage fatigue as a foreseeable risk, the prescribed rest and meal breaks, and the duty to accommodate diagnosed conditions.

Professional services firms - law, accounting, consulting - answer to exactly the same four bodies as every other New Zealand employer: WorkSafe (safety), the Human Rights Commission (disability discrimination), the employment authorities (hours and pay), and ACC (no-fault injury). Professional bodies like the Law Society oversee ethics and competence, not fatigue or hours.
You must eliminate or minimise fatigue risk so far as is reasonably practicable under the Health and Safety at Work Act 2015, and partners, directors and senior managers carry a personal due-diligence duty to verify that fatigue is actually being managed rather than tolerated. Rest and meal breaks are prescribed and scale with the day: two paid 10-minute rest breaks and an unpaid 30-minute meal break across six to eight hours, more beyond that. No law limits how many hours a lawyer, accountant or consultant may work, and none gives staff a right to ignore after-hours email, so the only control on a long-hours culture is your own risk management.
WorkSafe New Zealand can investigate any fatigue-linked incident involving your people, issue improvement or prohibition notices, and prosecute in the District Court, and it needs no sector-specific hours rule to do it. Because there is no prescriptive standard to comply with, a prosecution turns entirely on the evidence you can produce that you identified and controlled the risk; the court orders reparation to the affected person or their family before it sets the fine. Failing to provide prescribed breaks is separately enforceable as a breach of a minimum employment standard, and refusing adjustments for a diagnosed sleep condition can be taken to the Human Rights Review Tribunal, where damages are uncapped.
Under the Health and Safety at Work Act 2015 a firm faces up to $1.5 million for exposing people to serious risk and $3 million for reckless conduct; a partner, director or senior manager faces $300,000 personally, or $600,000 and five years' imprisonment. Reparation to the affected person is ordered on top. Employment-standard breaches carry penalties to $20,000 each, or $100,000 for serious breaches. 2015 Act levels, current August 2026.

A surveyor who had worked a long day surveying a farm for his employer, finishing at about 10pm, died in the early hours when his utility vehicle left a rural road. The coroner found that after the long day he appeared tired and fell asleep. After an earlier accident, he had written to his employer that his workload was unrealistic and harming his health. The coroner said he could not tie the long hours to any obligation placed by the employer. He recommended that his findings go to the labour department to investigate driving while over-tired in employment.
