El sueño y la fatiga en centros de llamadas y bpo

Regulación

El detalle normativo y de investigación de esta página se muestra en inglés.

Contact center work is the most fatigue-exposed office work in the country and among the least regulated. The Bureau of Labor Statistics counts 2.67 million customer service representatives and states plainly that centers open around the clock require shifts early in the morning and late at night. No federal or state rule limits shift length, night work or consecutive days for them. Unlike your salaried staff, most agents are not exempt, so overtime is payable, but overtime is a price rather than a ceiling.

Quién la regula

In the US, call center and BPO fatigue risk sits under general workplace law, not an industry-specific rule. OSHA enforces a general duty to provide a safe workplace; NIOSH offers research and guidance only. The EEOC oversees accommodation for diagnosed sleep disorders, the Department of Labor administers related leave and overtime rules, and state workers' comp covers fatigue-related incidents.

Sus obligaciones

Keep your workplace free of recognized hazards likely to cause death or serious harm. On a 24-hour rotating roster, fatigue is the recognized hazard most likely to be put to you. Pay overtime past forty hours. In Illinois, give every agent 24 consecutive hours of rest in each consecutive seven-day period, plus a twenty-minute meal break in each seven-and-a-half-hour shift. In California, give one day's rest in seven. Accommodate a diagnosed sleep disorder, and run any screening as a voluntary health program with confidential records.

Consecuencias

A citation for leaving a recognized fatigue hazard unaddressed comes with an abatement order and a public record, and your rosters and overtime records become the evidence. Missing a required rest day or meal break in Illinois or California is a wage-hour claim across a whole shift pattern, not an individual one, which is what makes it expensive. Screening handled badly is a discrimination charge. Claim frequency on overnight and rotating shifts drives your workers' compensation experience modification.

Sanciones

OSHA maximums are at 2025 levels and carry into 2026 unchanged, because the federal inflation adjustment was cancelled this year: $16,550 per serious or other-than-serious violation, $165,514 per willful or repeat violation, and $16,550 per day for failure to abate. Disability discrimination damages are capped by headcount from $50,000 to $300,000, with back pay uncapped. State day-of-rest and meal-break claims are enforced separately.

Antecedentes

No US court, coroner, investigator or regulator has published a finding linking fatigue to an incident in contact centers. Fatigue still falls under OSHA's General Duty Clause as a recognized hazard.

Was It Fatigue?

Apoya su deber general de cuidado

29 CFR Part 1904 requires you to record injuries, not to investigate their cause, and no US rule names a fatigue review. Was It Fatigue? supports your own investigation. A structured judgment aid, not a determination of cause.

SleepWellBaby

SleepWellBaby supports parents returning to work after a birth, when broken infant sleep is at its worst. No US regulation requires it and none is engaged; it is offered as a benefit, not an obligation.

Acerca de SleepWellBaby

Fatiguefit4Duty

Fatiguefit4Duty is built for safety-sensitive roles at the point of duty. Contact center roles are generally not safety-sensitive and no US rule requires a fitness-for-duty check, so nothing is engaged.
