El sueño y la fatiga en telecomunicaciones

Network operations centers run 24/7 shifts and field crews work call-outs and storm restoration, driving long distances. Fatigue slows fault response and adds driving and height risk.

Cambio recienteDesde el 4 de junio de 2026

Se aplica a todas las industrias en Estados Unidos

If you have workers in Colorado exposed to extreme heat or cold, a law signed 4 June 2026 requires a temperature illness prevention plan and worker training, with your plan due to the state by 1 September 2028.

Próximo cambioPrevisto a partir de octubre de 2027En los próximos 12 meses

OSHA's heat injury and illness standard, proposed August 2024, is still a proposal: a supplemental proposal is projected for December 2026 and final action for October 2027, with no compliance date set. Colorado plans are due 1 September 2028; Virginia must adopt heat rules by 1 May 2028.

Cambios normativos revisados al 1 de octubre de 2026.

Regulación

Quién la regula y qué espera

El detalle normativo y de investigación de esta página se muestra en inglés.

Telecommunications has no fatigue rule at all. OSHA's telecommunications standard, 29 CFR 1910.268, runs from climbing and ladders to overhead and underground lines and never mentions hours, rest or fatigue. Nothing in the FCC's outage reporting and reliability requirements sets staffing, shift limits or crew rest, and OSHA's long-running attention to tower climber deaths has never named fatigue as a cause. So the obligation carrying the weight is the general duty to keep the workplace free of recognized hazards, and it bites hardest on round-the-clock network operations and multi-day restoration.

Quién la regula

OSHA has a telecommunications-specific safety standard, but it covers physical hazards like climbing and electrical safety, not fatigue. The general federal safety and disability protections apply for everything fatigue-related.

Sus obligaciones

Keep your workplace free of recognized hazards causing or likely to cause death or serious physical harm - that is the provision a fatigue case is brought under, and it applies whatever your headcount. Accommodate a diagnosed sleep disorder as a disability and provide protected leave where the condition qualifies. Cover fatigue-related injuries through workers' compensation. OSHA's telecommunications standard governs climbing, live plant and overhead and underground line work, and citations under it can be issued alongside a general duty citation arising from the same extended-hours restoration.

Consecuencias

Exposure runs through the general channels. A general duty citation where extended restoration hours are shown to have created a recognized hazard your industry knows how to control. Separate citations under the telecommunications standard for the physical failures a tired crew is likelier to make - climbing, fall protection, work near energised plant. Disability accommodation claims where a sleep disorder was known and not accommodated. Workers' compensation for the injury itself, and tort exposure for anyone who is not your employee.

Sanciones

OSHA maximums are 2025 levels, in force for 2026, because no federal inflation adjustment was made this year: $16,550 per serious or other-than-serious violation, $16,550 per day for failure to abate, and $165,514 per willful or repeat violation. Citations under the telecommunications standard are assessed on the same scale and can stack with a general duty citation arising from the same event.

Network monitor with narcolepsy keeps falling asleep despite naps and no nights; court finds her not qualified

  • Legal

An operations center specialist at a telecommunications company, who monitored network outages and dispatched repair technicians, often alone on shift, had narcolepsy. She admitted falling asleep while monitoring the network and during calls, even after supervisors gave her an extra nap break, excused her from night shifts and allowed monthly medical leave. Her doctors said she would keep falling asleep unpredictably. The federal appeals court held she was not a qualified individual and upheld summary judgment for the employer.
