Regulación

Quién la regula y qué espera

El detalle normativo y de investigación de esta página se muestra en inglés.

Childcare is licensed state by state, and the licensing codes regulate ratios and group sizes, not the educator's working day. Nothing in the Child Care and Development Fund health and safety requirements at 45 CFR 98.41 touches hours, shift length or rest. The Fair Labor Standards Act prices overtime after 40 hours and caps nothing. Oregon's predictive scheduling law reaches retail, hospitality and food service, not childcare. On fatigue your obligation is the General Duty Clause and ordinary negligence.

Quién la regula

Childcare has no single federal regulator and no fatigue standard. Every state licenses centers and family child care homes and sets staff-to-child ratios - a child-safety rule, not a fatigue safeguard. OSHA's general duty covers private centers, and publicly run programs only where a state plan reaches public employees. The Department of Labor governs wages and leave and the EEOC accommodation.

Sus obligaciones

Meet your state's staff-to-child ratios and group size limits at all times, including across breaks and shift changes. If you take Child Care and Development Fund money, train staff in the health and safety topics at 45 CFR 98.41 - none of which is fatigue. Pay overtime after 40 hours in a week, and treat a meal break as paid working time whenever the educator is still supervising children. Keep the workplace free of recognized hazards, and accommodate a diagnosed sleep disorder under the ADA.

Consecuencias

A ratio breach is the enforcement risk that matters: corrective action, fines, and for a serious or repeated breach suspension or revocation of the license, which closes the center. A supervision lapse that injures a child becomes a negligence claim and in the worst cases a criminal one. OSHA reaches fatigue only through the General Duty Clause and only where the hazard is recognized. Meal breaks spent supervising children are a wage claim. Workers' compensation covers the educator's own injury.

Sanciones

OSHA maximums are at 2025 levels and in force for 2026: $16,550 serious or other-than-serious, $165,514 willful or repeat, $16,550 per day failure to abate. State licensing fines are set state by state and no national figure exists; suspension or revocation of the license is the consequential lever. Unpaid working meal breaks attract FLSA back wages and liquidated damages.

Child care van driver with a likely undiagnosed sleep disorder falls asleep on the school run; four children and the driver killed

  • Seguridad

A driver for a Tennessee child care center was taking six children to school in a 15-passenger van when it left an interstate highway. The National Transportation Safety Board found he fell asleep at the wheel, quite likely because of an undiagnosed sleep disorder, and named the absence of oversight by the child care operator in the probable cause. Four children and the driver were killed and two children were seriously injured.

Sleepfit

Apoya su deber general de cuidado

Screens a low-paid, high-turnover workforce for sleep disorders and distress risk. No state licensing code and no CCDF requirement names screening, so this is voluntary risk reduction.

Acerca de Sleepfit

Fatiguefit4Duty

Apoya su deber general de cuidado

Flags fatigue risk before an educator carries ratio responsibility alone. No US childcare rule requires a fitness check, so the argument here is general duty and negligence exposure.

Acerca de Fatiguefit4Duty

Awareness eLearning

Apoya su deber general de cuidado

CCDF health and safety training at 45 CFR 98.41 lists its required topics and fatigue is not among them, so this adds awareness coverage that the federal rule does not require of you.

Acerca de Awareness eLearning

Was It Fatigue?

Apoya su deber general de cuidado

Gives a documented causal trail after a supervision lapse or an injury. No US childcare regulation requires fatigue to be considered in an investigation, so this supports defensibility.

Acerca de Was It Fatigue?

SleepWellBaby

Supports educators whose own sleep is broken by an infant at home. Nothing in state licensing or in the CCDF rules touches worker sleep, so this sits with retention rather than compliance.
