No state insurance department and no national model law says anything about how long a claims adjuster may be deployed or how many hours they may work. Catastrophe response routinely puts adjusters into disaster zones on long days for weeks at a time, and nothing in insurance regulation limits it. Your fatigue exposure is the ordinary employer's: the duty to keep the workplace free of recognized hazards, the disability rules that govern any screening you run, workers' compensation, and the negligence claim after a tired adjuster crashes.

Quién la regula

OSHA for workplace safety, the EEOC for disability accommodation, and the US Department of Labor for family and medical leave - the same bodies that cover any office employer. State insurance departments and the NAIC regulate how you underwrite and handle claims, not how you manage your own staff; state workers' compensation systems sit behind fatigue-related injuries across every industry you insure.

Sus obligaciones

Keep your workplace free of recognized hazards likely to cause death or serious harm. On a catastrophe deployment, with long consecutive days and driving between sites, that duty is at its most arguable. Pay overtime to any adjuster or examiner who is not exempt. Accommodate a diagnosed sleep disorder through the interactive process. If you screen your people, run it as a voluntary health program with results on separate forms in separate confidential medical files. In California, give every worker one day's rest in seven.

Consecuencias

A citation for leaving a recognized fatigue hazard unaddressed comes with an abatement order and a public record, and a repeat finding moves you into the willful tier. The larger exposure on a catastrophe deployment is the third party: workers' compensation covers your own injured adjuster and bars them suing you, and does nothing for the driver they hit. Screening handled badly is a discrimination charge and federal litigation. Claim frequency on deployed teams also drives your own experience modification.

Sanciones

OSHA maximums are at 2025 levels and carry into 2026 unchanged, because the federal inflation adjustment was cancelled this year: $16,550 per serious or other-than-serious violation, $165,514 per willful or repeat violation, and $16,550 per day for failure to abate. Disability discrimination damages are capped by headcount from $50,000 to $300,000, with back pay uncapped. Third-party negligence damages are uncapped.

Insurer's trainer who says he fell asleep in meetings is told he is being let go days after asking for leave for a sleep study; treated sleep apnea not a disability under federal law

  • Legal

A sales instructor at a health insurer in Texas said that from mid-1995 he became increasingly tired, could not concentrate, and fell asleep in meetings and at his desk, while the company cited ongoing performance problems. In 1997 he was given leave for a sleep study and, days later, notice of discharge; the study then found moderate obstructive sleep apnea, which CPAP treatment corrected. The federal court granted the insurer summary judgment because his corrected condition did not substantially limit a major life activity, he had not told the company of a disability before the discharge decision, and he offered no evidence that the documented performance reasons were a pretext.
