Night-shift police sergeant diagnosed with shift work sleep disorder is not disabled under federal disability law; court calls the condition 'commonplace' among night workers
A city police sergeant in North Carolina assigned to the 9:45 p.m. to 6:00 a.m. shift reported trouble sleeping, was briefly moved to a day post that was then eliminated, and in 1993 was diagnosed with shift work sleep disorder; her doctor recommended she not work nights. The department would not reassign her but allowed a voluntary swap, put her on daytime administrative duty at the same pay when no one volunteered, and offered other city jobs, which she refused. The federal court granted summary judgment to the city, holding that shift work sleep disorder, which the evidence showed affected most night workers, was not a disability under federal disability discrimination law.
