Government employment runs on the ordinary safety baseline, with two things worth knowing. Federal OSHA does not cover state and local government at all: 27 states plus Puerto Rico and the Virgin Islands cover public employees through an approved plan, and 23 states and the District of Columbia cover them through no plan at all. Federal agencies run their own equivalent program under Executive Order 12196, where OSHA inspects and issues notices but cannot fine an agency. Nothing in federal employment law limits how many hours a public employee may be required to work.

Quién la regula

OSHA sets the federal safety standard but does not reach state and local government employers directly; their staff are covered only through an approved state plan. Federal agencies run their own equivalent program under Executive Order 12196, overseen by OSHA. The Department of Labor governs overtime, including the special rule for police and fire crews, and the Office of Personnel Management the federal basic workweek.

Sus obligaciones

Your duty to provide a safe workplace comes from a different law depending on who you are. Federal agencies owe it under section 19 of the OSH Act, Executive Order 12196 and 29 CFR Part 1960. State and local employers owe it under an approved state plan in 27 states, and under state law elsewhere. Contractors owe it to OSHA directly. Federal employees have a 40-hour basic workweek and an 8-hour nonovertime day, which an agency head may set aside. No provision caps total hours or requires rest between tours. The ADA and FMLA apply throughout.

Consecuencias

Where you sit decides what follows. A contractor, or a public employer in an approved plan state, faces citation and monetary penalties. A federal agency does not: OSHA inspects and issues a Notice of Unsafe or Unhealthful Working Conditions requiring abatement, but cannot fine it. In 23 states and the District of Columbia there is no OSHA route to state or local government at all. For a federal employee, the Federal Employees' Compensation Act is the exclusive remedy and displaces tort entirely; state and local employees sit in their state scheme.

Sanciones

OSHA maximums are at 2025 levels and remain in force for 2026 - no adjustment was made this year: $16,550 per serious or other-than-serious violation and $165,514 per willful or repeat violation. They reach contractors and, through each plan's own rules, public employers in approved plan states. The federal agency program carries findings and abatement, not fines. No penalty anywhere attaches to hours worked, because no hours limit exists.

Analyst asleep at desk after a drowsy-side-effect sleep aid wins reinstatement and back pay; removal cut to suspension for inconsistent discipline

    • Financiero

A web application analyst at a Virginia state social services agency was photographed asleep at his desk for several minutes one afternoon, after taking a non-prescription medication with a drowsiness side effect the night before because he could not sleep. A sleep study afterwards found sleep apnea and he began CPAP treatment. The hearing officer cut his removal to a 10-workday suspension because the agency had given a colleague in the same division who also slept at work a lesser penalty first, and ordered reinstatement with back pay; $5,855.70 in attorneys' fees followed.
