Cambio recienteDesde el 4 de junio de 2026

Se aplica a todas las industrias en Estados Unidos

If you have workers in Colorado exposed to extreme heat or cold, a law signed 4 June 2026 requires a temperature illness prevention plan and worker training, with your plan due to the state by 1 September 2028.

Próximo cambioPrevisto a partir de octubre de 2027En los próximos 12 meses

OSHA's heat injury and illness standard, proposed August 2024, is still a proposal: a supplemental proposal is projected for December 2026 and final action for October 2027, with no compliance date set. Colorado plans are due 1 September 2028; Virginia must adopt heat rules by 1 May 2028.

Cambios normativos revisados al 1 de octubre de 2026.

Regulación

Quién la regula y qué espera

El detalle normativo y de investigación de esta página se muestra en inglés.

Waste collection is one of the most dangerous civilian jobs in the US: refuse and recyclable material collectors had a fatal injury rate of 37.4 per 100,000 full-time workers in 2024, fifth highest of any occupation. No federal rule addresses fatigue in the industry directly. Private haulers' drivers work under hours-of-service rules, mostly under the short-haul exception; municipal crews are outside them. Everyone else, from sorters to landfill operators, sits under OSHA's general duty.

Quién la regula

OSHA enforces the general duty across collection, transfer, landfill and recycling, and OSHA-approved State Plans also cover municipal sanitation crews in their states. FMCSA sets hours-of-service and driver medical rules for private haulers in interstate commerce; states apply their own rules to intrastate haulers, and municipal fleets are outside FMCSA rules. The EEOC oversees disability rules on sleep disorders.

Sus obligaciones

Keep your workplace free of recognized hazards, which reaches fatigue where pre-dawn starts and long days make it foreseeable. For private drivers in interstate commerce, apply hours of service: under the short-haul exception a driver stays within 150 air-miles, is released within 14 hours, has 10 hours off between shifts, and you keep time records instead of logs. Those drivers need a current medical certificate, and every driver of a heavy truck needs a commercial driver's license, municipal drivers included. Run any screening as a voluntary program.

Consecuencias

A fatigue hazard left unaddressed after an inspection brings a citation and abatement order under OSHA's general duty, with repeat and willful tiers. Hours-of-service and records violations bring roadside out-of-service orders and FMCSA civil penalties, and move your public safety score. A collection truck crash that injures a member of the public brings uncapped negligence claims that workers' compensation does nothing to limit.

Sanciones

OSHA maximums, 2025 levels in force through 2026: $16,550 per serious violation and $165,514 per willful or repeat violation. FMCSA maximums in force for 2026: $19,246 per safety-regulation violation, $4,812 where the driver commits it, and $15,846 for knowingly falsifying a record. Third-party negligence damages are uncapped.

Garbage truck driver with sleep apnea falls asleep at the wheel; later firing upheld as due to no-shows

  • Seguridad
  • Legal

A garbage truck driver for a waste company, who had obstructive sleep apnea, fell asleep at the wheel in 2020 and almost rear-ended another vehicle. The employer granted medical leave, but after it ended he missed a shift and then four consecutive shifts without notice and was fired under the attendance policy. The federal appeals court held that no reasonable jury could find the firing was because of his sleep apnea rather than his unexplained absences.

Was It Fatigue?

Apoya su deber general de cuidado

OSHA recordkeeping rules require you to record injuries, not to investigate their cause, and no rule asks whether fatigue contributed to a collection crash. Was It Fatigue? supports your own review. A structured judgment aid, not a determination of cause.
