Le sommeil et la fatigue : centres d’appels et impartition des processus d’affaires

Réglementation

Qui la réglemente, et ce qui est attendu

Which law governs your contact center depends on whose work it does. An in-house center of a bank or a telecom carrier is federally regulated under the Canada Labor Code, as is an outsourced center whose work is integral to a federal undertaking; every other center is provincially regulated. Federally that means 96 hours' notice of a schedule, 24 hours' notice of a shift change, 8 consecutive hours off between shifts and a 30-minute break every 5 hours. In Ontario it means 11 consecutive hours off each day, 8 hours between shifts, 24 hours off each week and a 30-minute eating period after 5 hours, plus three hours' pay when a shift is cut short.

Qui la réglemente

Two regimes, and the client you serve decides which. In-house bank and telecom centers, and outsourced centers integral to a federal undertaking, answer to the ESDC Labor Program under the Canada Labor Code. Every other operator answers to a provincial labor ministry - in Ontario the Ministry of Labor under the Occupational Health and Safety Act and Employment Standards Act, with the Human Rights Tribunal and the WSIB.

Vos obligations

Settle which regime you are in first, because it changes your rosters. Federal centers owe the Part II duty to protect health and safety plus Part III scheduling: 96 hours' written notice of a schedule, 24 hours' notice of a shift change, 8 consecutive hours off between shifts and a 30-minute break every 5 hours. Ontario centers owe every reasonable precaution, a written safety policy above five workers, 11 consecutive hours off daily, 24 hours off weekly, a 30-minute eating period after 5 hours, and three hours' pay when an agent who normally works longer is sent home early. Both regimes require accommodation of a diagnosed sleep disorder.

Conséquences

Federally, a Canada Labor Code Part II contravention carries up to $1,000,000 and two years' imprisonment on indictment, $1,000,000 on summary conviction where it directly causes death or serious injury, and administrative monetary penalties of up to $250,000 per violation without any prosecution. If you are provincially regulated in Ontario, the Occupational Health and Safety Act carries up to $2,000,000 for a corporation, $1,500,000 for a director or officer and $500,000 for any other individual. Employment standards contraventions draw $250 per affected employee, rising to $500 and then $5,000 for repeats within three years. Accommodation failures go to the federal or Ontario human rights tribunal.

Sanctions

Federal maximums, 2026: $1,000,000 and two years' imprisonment on indictment under Canada Labor Code Part II, $1,000,000 on summary conviction where it directly causes death or serious injury, and administrative penalties capped at $250,000 per violation. Ontario maximums: $2,000,000 for a corporation, $1,500,000 for a director or officer and $500,000 for any other individual, plus a $500,000 minimum for a repeat corporate offence causing death or serious injury.

Antécédents

No Canadian court, coroner, investigator or regulator has published a finding linking fatigue to an incident in contact centers. The duty to manage fatigue still sits within the general duty in federal and provincial occupational health and safety law.

Was It Fatigue?

Soutient votre devoir général de diligence

Your duty to investigate workplace incidents under provincial OHS law or s 125(1)(c) of the Canada Labor Code does not name fatigue in contact center work. Was It Fatigue? supports that investigation. A structured judgment aid, not a determination of cause.

À propos de Was It Fatigue?

SleepWellBaby

No Canadian contact center rule reaches sleep in new-parent households. SleepWellBaby is offered as a benefit to parents on your contact center rosters; it is not a compliance step and sits outside your health and safety obligations.

À propos de SleepWellBaby

Fatiguefit4Duty
