Le sommeil et la fatigue : services financiers et bancaires
Office-based work with long hours at peaks and some early or overnight market and operations shifts. The direct safety consequence is low; poor sleep costs decision quality and wellbeing.

Your bank is a federally regulated employer: banks and authorized foreign banks are on the federal list, so the Canada Labor Code governs your workforce, not provincial employment standards. Since 2019 that includes 96 hours' written notice of a work schedule, 24 hours' notice of a shift change, 8 consecutive hours off between shifts and a 30-minute break every 5 hours. Credit unions and most non-bank financial firms are provincially regulated instead, so two finance employers in one tower can sit under different hours regimes. No fatigue-specific banking rule exists; the general federal duty to protect health and safety is what carries fatigue risk.

Qui la réglemente
The ESDC Labor Program enforces the Canada Labor Code for you - Part II for health and safety, Part III for hours of work - with the Canadian Human Rights Commission handling accommodation. OSFI supervises the same banks for capital and risk; its mandate is financial soundness, not employee hours or fatigue. Credit unions and most non-bank financial firms are outside federal jurisdiction and answer to provincial regulators.
Vos obligations
Canada Labor Code Part II requires you to ensure the health and safety at work of every employee is protected, which reaches fatigue in your shift-based operations - contact centers, IT and data center teams, security. Part III sets standard hours of 8 a day and 40 a week with a 48-hour ceiling, 96 hours' written notice of a schedule, 24 hours' notice of a shift change or added shift, at least 8 consecutive hours off between shifts, and a 30-minute break every 5 consecutive hours. Managers and listed professionals are excluded from those hours rules. You must accommodate a diagnosed sleep disorder to undue hardship.
Conséquences
A Part II contravention carries a fine of up to $1,000,000 and up to two years' imprisonment on indictment; where it directly causes death, serious illness or serious injury, or is wilful with knowledge that it was likely to, $1,000,000 is also the summary conviction maximum. Labor Program inspectors can skip prosecution entirely and issue an administrative monetary penalty of up to $250,000 per violation. Failing to accommodate a diagnosed sleep disorder is a separate track before the Canadian Human Rights Tribunal, which can order lost wages, reinstatement and damages for injury to dignity. Ontario's $2,000,000 safety fines do not reach you - federal law does, and it is enforced federally.
Sanctions
Canada Labor Code maximums in force in 2026: $1,000,000 and two years' imprisonment on conviction on indictment for a Part II contravention, $100,000 on summary conviction, rising to $1,000,000 on summary conviction where the contravention directly causes death or serious injury or is wilful. Administrative monetary penalties, issued by inspectors without any prosecution, are capped at $250,000 per violation.
Antécédents
No Canadian court, coroner, investigator or regulator has published a finding linking fatigue to an incident in financial services. The duty to manage fatigue still sits within the general duty in federal and provincial occupational health and safety law.

Sleepfit
Soutient votre devoir général de diligence
No Canadian financial services rule requires a sleep health screen for bank and finance staff. Sleepfit supports your general duty to protect worker health under provincial OHS law or s 124 of the Canada Labor Code. It screens; diagnosis stays with your clinicians.
Your duty to give bank and finance staff the information, instruction and training they need, under provincial OHS law or s 125(1)(q) of the Canada Labor Code, does not name fatigue. Awareness eLearning supplies fatigue and sleep content with a completion record.
Your duty to investigate workplace incidents under provincial OHS law or s 125(1)(c) of the Canada Labor Code does not name fatigue in financial services work. Was It Fatigue? supports that investigation. A structured judgment aid, not a determination of cause.
No Canadian financial services rule reaches sleep in new-parent households. SleepWellBaby is offered as a benefit to parents across your branches and offices; it is not a compliance step and sits outside your health and safety obligations.
Fatiguefit4Duty is built for safety-sensitive roles at the point of duty. Banking and financial services roles are generally not safety-sensitive and no Canadian rule requires a fitness-for-duty check, so nothing is engaged.
