El sueño y la fatiga en construcción

Mostly day work with early starts, long hours, overtime and long commutes, plus night works on roads and rail. Fatigue near heavy plant, at heights and on the drive home can be fatal.

Cambio recienteDesde el 4 de junio de 2026

Se aplica a todas las industrias en Estados Unidos

If you have workers in Colorado exposed to extreme heat or cold, a law signed 4 June 2026 requires a temperature illness prevention plan and worker training, with your plan due to the state by 1 September 2028.

Próximo cambioPrevisto a partir de octubre de 2027En los próximos 12 meses

OSHA's heat injury and illness standard, proposed August 2024, is still a proposal: a supplemental proposal is projected for December 2026 and final action for October 2027, with no compliance date set. Colorado plans are due 1 September 2028; Virginia must adopt heat rules by 1 May 2028.

Cambios normativos revisados al 1 de octubre de 2026.

Regulación

Quién la regula y qué espera

El detalle normativo y de investigación de esta página se muestra en inglés.

No federal law limits how many hours a construction worker can be scheduled, and nothing in OSHA's construction standards sets a shift length or a rest period. What binds you is the general duty to keep the site free of recognized hazards. Two things sharpen that. As a general contractor you can be cited for a hazard your subcontractor's workers are exposed to, under OSHA's controlling-employer policy. And in California, Wage Order 16 gives on-site construction workers a meal period, paid rest periods and the equivalent of one day's rest in seven, enforceable independently of any safety rule.

Quién la regula

Federal OSHA sets the construction safety standards and enforces the underlying duty to address recognized hazards, including fatigue. California, Oregon, Washington and Maryland run their own binding heat rules that construction employers must follow directly, enforced by the state agency rather than federal OSHA. State workers' compensation schemes, the ADA and the FMLA apply everywhere.

Sus obligaciones

Treat fatigue from long or back-to-back shifts as a recognized hazard and control it, because no construction standard sets a limit for you. If you hold general supervisory authority over a site you must exercise reasonable care to prevent and detect violations affecting anyone working there, not only your own employees. In California give a 30-minute meal period before the end of the fifth hour, 10 minutes of paid rest for every four hours, and the equivalent of one day's rest in seven each calendar month. Where a state heat rule applies, it binds you directly and the detail differs by state.

Consecuencias

OSHA can cite fatigue only as a recognized hazard under the general duty clause, and it must show the hazard was recognized and that a workable fix existed. That is a harder case to bring than a standards citation, which is why almost every fatigue exposure reaches you another way: a fall, a struck-by or a vehicle incident cited under a specific standard, with fatigue in the background. In New York, owners and contractors carry near-absolute liability for height-related failures under the Scaffold Law. Missed California meal or rest periods cost an hour's pay each, each day.

Sanciones

OSHA maximums at 2025 levels, in force for 2026: $16,550 per serious or other-than-serious violation ($1,085 minimum for serious), $165,514 per willful or repeat violation ($11,823 minimum for willful), and $16,550 per day for failure to abate. California adds one hour of pay per employee per day for each missed meal period and each missed rest period.

Building contractor on his way to work drifts into a group of cyclists, likely fatigued; two killed, 14 hurt

    • Seguridad

A self-employed building contractor driving his pickup to work drifted out of his lane on a bridge in Arizona and struck a group of cyclists. The National Transportation Safety Board found the probable cause was his diminished state of alertness, likely due to fatigue, pointing to limited sleep opportunity, a shallow lane departure, no reaction to the riders and braking only about 6 seconds after impact. Two cyclists were killed and 14 were injured.
