El sueño y la fatiga en manufactura

Continuous-process plants run rotating 8- and 12-hour shifts including nights. Fatigue on monotonous tasks near machinery and forklifts raises the risk of injury, defects and process incidents.

Cambio recienteDesde el 4 de junio de 2026

Se aplica a todas las industrias en Estados Unidos

If you have workers in Colorado exposed to extreme heat or cold, a law signed 4 June 2026 requires a temperature illness prevention plan and worker training, with your plan due to the state by 1 September 2028.

Próximo cambioPrevisto a partir de octubre de 2027En los próximos 12 meses

OSHA's heat injury and illness standard, proposed August 2024, is still a proposal: a supplemental proposal is projected for December 2026 and final action for October 2027, with no compliance date set. Colorado plans are due 1 September 2028; Virginia must adopt heat rules by 1 May 2028.

Cambios normativos revisados al 1 de octubre de 2026.

Regulación

Quién la regula y qué espera

El detalle normativo y de investigación de esta página se muestra en inglés.

Manufacturing has no fatigue-specific federal rule and no cap on hours. OSHA's process safety management standard, which governs the most hazardous plants in the country, says nothing about staffing, shift length or overtime - it requires only that the process hazard analysis address human factors. Federal wage law prices overtime and caps nothing. The real constraint is state law: New York, California, Illinois, Wisconsin and Massachusetts each require a day of rest in seven, and every one of them reaches factory work.

Quién la regula

OSHA is the governing safety regulator for US manufacturing, alongside the EEOC for disability accommodation and the Department of Labor for overtime and family and medical leave. The Chemical Safety Board investigates major process incidents and has repeatedly identified fatigue as a factor, but it makes recommendations only and cannot fine anyone. There is no dedicated fatigue regulator for the sector.

Sus obligaciones

Keep the plant free of recognized hazards, because no federal standard sets a maximum shift or a minimum rest period for manufacturing. Give a day of rest in seven where your state requires it: New York and Wisconsin for factories, Massachusetts for manufacturing and mechanical establishments, Illinois for twenty-four consecutive hours in every seven-day period, California for one day's rest in seven in any occupation. Address human factors in your process hazard analysis if you are a covered process. California refineries must go further and assess employee fatigue directly.

Consecuencias

OSHA can cite fatigue only as a recognized hazard under the general duty clause, which it must prove was recognized and workably fixable - a harder case than a standards citation. Day-of-rest breaches are enforced by state labor departments and carry their own penalties, in Illinois payable to the department and again to each affected employee. Fatigue-related injuries on the floor are compensable regardless of fault and raise the injury rates that put you on OSHA's targeting list. A diagnosed sleep disorder brings separate ADA and FMLA duties.

Sanciones

OSHA maximums at 2025 levels, in force for 2026: $16,550 per serious or other-than-serious violation ($1,085 minimum for serious), $165,514 per willful or repeat violation ($11,823 minimum for willful), $16,550 per day for failure to abate. Illinois day-of-rest penalties, at 2023 levels: $250 per offence to the department and up to $250 to each affected employee under twenty-five employees; $500 and $500 at twenty-five or more.

Manufacturer pays $275,000 after firing worker it wrongly believed had disabling sleep apnea

    • Legal
    • Financiero

An industrial device manufacturer dismissed an employee because it assumed his sleep apnea and a heart condition made him unable to work. The Equal Employment Opportunity Commission sued under the Americans with Disabilities Act, saying the worker was fully capable of the job and was fired on stereotypes. The company settled for $275,000 and agreed to training and reporting obligations. The lesson: a sleep disorder should be assessed and managed, not treated as automatic grounds for dismissal.

Sleepfit

Apoya su deber general de cuidado

Five states give factory workers a day of rest in seven, and none of them asks what your people sleep. California refineries must assess employee fatigue. Sleepfit supports that with cohort-level sleep data.

Acerca de Sleepfit

Fatiguefit4Duty

Apoya su deber general de cuidado

Process safety management asks you to address human factors and does not name fatigue. California refineries must assess it directly. Fatiguefit4Duty supports both with measured data for safety-sensitive roles.

Acerca de Fatiguefit4Duty

Awareness eLearning

Apoya su deber general de cuidado

No federal manufacturing rule requires fatigue training; process safety training under 29 CFR 1910.119(g) covers the process, not the operator's state. Awareness eLearning supplies fatigue and sleep content with a completion record.

Acerca de Awareness eLearning

Was It Fatigue?

Apoya su deber general de cuidado

A process safety incident investigation must identify the factors that contributed, and fatigue is not named as one of them. Was It Fatigue? supports that investigation with a structured account of sleep.

SleepWellBaby

No US manufacturing rule reaches sleep in new-parent households. This is a workforce decision rather than a compliance one, and it supports the wider fatigue picture on rotating and night shift lines.
