Le sommeil et la fatigue : services correctionnels et de détention

Custodial officers work 24/7 rotating rosters with nights, overtime and extended shifts. Fatigue impairs vigilance, threat assessment and de-escalation where incidents escalate fast.

Réglementation

Qui la réglemente, et ce qui est attendu

Les détails réglementaires et les données de recherche de cette page sont présentés en anglais.

No corrections-specific fatigue or hours-of-work rule exists in Canada, federal or provincial, and the jurisdictional split matters. Correctional Service Canada is a federal department: its officers get the Canada Labor Code duty to have their safety protected, but not the Code's hours-of-work standards, which do not apply to federal departments. Shift length, overtime and rest come from the CX collective agreement and from Commissioner's Directives that govern deployment and post assignment rather than fatigue. Provincial jails run on provincial law. The real driver of officer fatigue, forced overtime from understaffing, is bargained, not regulated.

Qui la réglemente

Federal correctional officers work for Correctional Service Canada, a federal department. The Canada Labor Code's health and safety Part applies to them; its hours-of-work Part does not reach federal departments, so shift length and overtime come from the CX collective agreement and internal Commissioner's Directives. Provincial correctional officers fall under their own province's safety and employment standards law instead.

Vos obligations

Correctional Service Canada owes officers the federal duty to ensure their health and safety is protected, must run a hazard prevention program, consult its workplace health and safety committees, and assess risk before reducing officer complement at an institution. What it does not owe them is a statutory limit on hours: the Canada Labor Code's hours-of-work standards do not apply to federal departments, so shift length, overtime and rest between shifts are collective agreement matters. Provincial correctional employers owe the ordinary safety duty and employment standards of their province, which do set daily and weekly limits and minimum rest.

Conséquences

A fatigue-related incident in a federal institution is handled under the Canada Labor Code: directions from a health and safety officer, administrative monetary penalties, and prosecution where the breach is serious. In a provincial jail it is a provincial safety prosecution. Neither regime has a fatigue offence, so the case turns on whether you managed a hazard you knew about. Two softer consequences bite more often. Forced overtime generates grievances and arbitration under the collective agreement. And correctional workers are among the occupations whose post-traumatic stress disorder Ontario presumes to be work-related, so sleep-disrupting psychological injury claims are accepted unless you rebut it.

Sanctions

Federal institutions: Canada Labor Code fines up to $1,000,000 and up to two years' imprisonment on indictment, plus administrative monetary penalties, which for a federal department run to $50,000 a violation and $150,000 where there is a history of non-compliance in the past five years. Provincial institutions: the province's maximums. Ontario, current in 2026: $2,000,000 for a corporation, $1,500,000 for a director or officer and $500,000 for any other individual.

Prison wrong to apply 8-hour rest rule to bar officer from overtime; board says fitness must be judged case by case

  • Juridique

A federal prison refused a correctional officer an overnight overtime shift (23:00 to 07:00) because his scheduled day shift ended at 19:45, leaving only 3 hours and 15 minutes of rest. A manager said the concern was something happening at the institution because an employee was too tired or not alert enough. The labor board held that the collective agreement's 8-hour rest rule does not apply to overtime, and that the employer could not make a predetermined, subjective decision about fitness without speaking to the officer. It added that the employer keeps the full right to send an employee home without pay if it believes he is too tired to work.
