Le sommeil et la fatigue : pétrole et gaz

Offshore and remote crews work 12-hour shifts on multi-week rotations, often swinging between days and nights, in shared quarters. Fatigue in major-hazard operations can be catastrophic.

Changement récentDepuis le 30 janvier 2026

S’applique à tous les secteurs (Canada)

Changement à venirPrévu à compter de 30 janvier 2027D’ici 12 mois

Federally regulated employers, including those under the renamed Oil and Gas Occupational Safety and Health Regulations, must apply the thermal stress amendments (SOR/2026-10) from 30 January 2027. Quebec employers have until 6 October 2026 to address psychosocial risks in a prevention program.

Changements réglementaires vérifiés au 1 octobre 2026.

Réglementation

Qui la réglemente, et ce qui est attendu

Les détails réglementaires et les données de recherche de cette page sont présentés en anglais.

No fatigue or hours-of-work rule specific to oil and gas exists in Canada, onshore or offshore. The Canada Energy Regulator's Onshore Pipeline Regulations contain no fatigue or control-room provision; the safety part of the Atlantic Accord Acts governing offshore petroleum work contains none either; and no Alberta Energy Regulator directive addresses hours, rest or camp rotations. What applies is the general provincial safety duty - British Columbia's OHS Regulation names fatigue as a source of impairment employers must consider - plus each province's own rest minimums, which govern camp rotations as any other schedule.

Qui la réglemente

Oil and gas is regulated for technical and environmental safety by the Alberta Energy Regulator, the BC Energy Regulator and, for interprovincial pipelines, the Canada Energy Regulator - none of which regulates worker fatigue. Workplace safety belongs to Alberta OHS or WorkSafeBC. Offshore, the Newfoundland and Nova Scotia offshore energy regulators administer safety under the Atlantic Accord Acts.

Vos obligations

Your duties come from the province you operate in, not from the energy regulator. You must take every reasonable precaution for worker safety, and fatigue sits inside that duty as a recognized form of impairment - British Columbia's OHS Regulation says so expressly. You must meet that province's hours-of-work and rest minimums for camp rotations and shift work; they are not the same across provinces, so an Alberta roster and a BC roster are measured against different floors. You must accommodate a diagnosed sleep disorder to the point of undue hardship. Offshore, the same pattern holds under the Accord Acts: general safety duties, no prescribed hours.

Conséquences

Because there is no oil and gas fatigue rule, there is no oil and gas fatigue penalty. A fatigue-related incident is handled as an ordinary failure of the general safety duty: an investigation and prosecution by the provincial safety regulator (Alberta OHS, or WorkSafeBC, which can also impose administrative penalties and adjust your claims costs), a human rights complaint if an accommodation was mishandled, and, offshore, enforcement by the offshore energy regulator under the Accord Acts. For a company operating an interprovincial pipeline, the federal Labor Program enforces the Canada Labor Code instead. Without a prescribed hours limit to point to, your defense is the fatigue program you can document.

Sanctions

Maximum fines are set by each province and differ, so there is no single Canadian figure for an oil and gas operator. Where a company is federally regulated - an interprovincial pipeline, say - the Canada Labor Code applies: on indictment up to $1,000,000 and two years' imprisonment; on summary conviction up to $100,000, rising to $1,000,000 where the breach directly caused death or serious injury. Those are the figures in force in 2026.

Antécédents

No Canadian court, coroner, investigator or regulator has published a finding linking fatigue to an incident in oil and gas. The duty to manage fatigue still sits within the general duty in federal and provincial occupational health and safety law.

Sleepfit

Soutient votre devoir général de diligence

In the Newfoundland and Labrador and Nova Scotia offshore areas, s 37 of the offshore OHS regulations makes fatigue impairment a prescribed risk; onshore, the general duty applies. Sleepfit supports identifying that risk. It screens; diagnosis stays with your clinicians.

Fatiguefit4Duty

Soutient votre devoir général de diligence

Offshore Newfoundland and Labrador and Nova Scotia, s 37(2) bars fatigue-impaired work without naming a method; onshore the general duty applies. Fatiguefit4Duty supports both. A fitness-for-duty check, not a fitness-for-duty decision - the duty call stays with you.

Awareness eLearning

Soutient votre devoir général de diligence

Offshore Newfoundland and Labrador and Nova Scotia, s 38 requires training on the factors that contribute to fatigue and on identifying and reporting it, and Awareness eLearning covers that content there. Onshore, the general training duty applies.

Was It Fatigue?

Soutient votre devoir général de diligence

Offshore Newfoundland and Labrador and Nova Scotia, s 37(3) requires impairment, fatigue included, to be considered as a possible cause in every incident investigation. Was It Fatigue? supports that review. A structured judgment aid, not a determination of cause.
