El sueño y la fatiga en comercio minorista y hotelería

Early starts, late closes, split shifts and night fill leave short turnarounds between shifts. The cost is mostly errors, service and turnover; night work and driving add safety risk.

El detalle normativo y de investigación de esta página se muestra en inglés.

There is no federal law on retail scheduling and fatigue. What exists is a set of city and state fair workweek laws that price a fatiguing roster rather than ban it: advance notice of the schedule, a minimum gap between one shift ending and the next beginning, and premium pay when a worker closes one night and opens the next. Oregon is the only statewide version. Six states separately require a day of rest each week, and Texas prohibits a seventh consecutive day in a shop. Whether any of it reaches you depends on where you trade and how large you are.

Quién la regula

There is no federal scheduling regulator. Enforcement sits with Oregon's Bureau of Labor and Industries statewide and with city and county labor agencies - New York City, Chicago, Seattle, Philadelphia, San Francisco, Los Angeles city and unincorporated Los Angeles County, Berkeley, Emeryville and Evanston. OSHA and the federal disability and leave agencies apply everywhere, whether or not a local scheduling law reaches you.

Sus obligaciones

These laws reach large employers, and the thresholds differ: 500 or more employees worldwide in Oregon and Seattle, 300 or more in Los Angeles city and county, 250 or more plus 30 locations in Philadelphia, 100 or more in Chicago, 56 or more in Berkeley and Emeryville. Where you are covered, expect 14 days' written notice and a minimum gap between shifts you may only encroach on with consent and premium pay: nine hours in Philadelphia, ten in Oregon, Seattle, Chicago and Los Angeles, eleven in Berkeley and Emeryville. New York City retail works differently: 72 hours' notice, no on-call shifts, no late cancellations, and no rest-gap rule at all.

Consecuencias

The premium is a wage debt, owed to every affected worker, uncapped, and it compounds fast across a large hourly workforce: one and a half times pay for every hour inside the rest period in Oregon, Seattle, Los Angeles, Berkeley and Emeryville, a quarter more in Chicago, and a flat $40 a shift in Philadelphia. City enforcement is assessed per violation, and New York City can add a further fine where it establishes a pattern. Where no ordinance reaches you, a fatigue-related incident still exposes you to a federal safety citation, to workers' compensation, and to the negligence claim a third party brings.

Sanciones

New York City retail scheduling violations run $500 for a first offence, up to $750 for a second within two years and up to $1,000 after that, with up to $15,000 more where the city establishes a pattern, plus damages to the workers. Requiring a seventh consecutive day in a Texas shop is a Class C misdemeanour. Federal safety maximums apply everywhere: $16,550 per serious violation and $165,514 per willful or repeat, at 2025 levels in force through 2026.

Court overturns $2 million verdict against convenience store chain: no duty to stop a new hire seen nodding off at work from driving home

    • Financiero

A convenience store chain employee on her third day was seen dozing off twice during training videos and nodding off while changing trash bags, said she was just tired, agreed to work an extra hour, then drove off and crossed the center line, killing a motorcyclist. She tested positive for amphetamine, benzodiazepine and buprenorphine and pleaded guilty to driving under the influence causing death. Juries put 30% of the fault on the chain, which was ordered to pay $2,043,792.82, but the Supreme Court of Appeals of West Virginia reversed: letting her work and drive was not affirmative conduct creating an unreasonable risk, so the chain owed no duty to stop her driving, and the estate pointed to no evidence that fatigue caused or contributed to the crash.
