Le sommeil et la fatigue : construction

Changement récentDepuis le 1 janvier 2026

Propre au secteur construction

In Ontario, OHSA administrative monetary penalties apply from 1 January 2026; the first prescribed breach concerns health and safety management systems in construction procurement (up to $100,000).

Changement à venirPrévu à compter de 6 octobre 2026D’ici 12 mois

Ontario is expected to add further contraventions to its OHSA administrative penalty regulation; no date is set. Quebec employers have until 6 October 2026 to have a prevention program (20 or more workers) or action plan in place that addresses psychosocial risks, including heavy workload.

Réglementation

Qui la réglemente, et ce qui est attendu

Les détails réglementaires et les données de recherche de cette page sont présentés en anglais.

No Canadian province regulates construction hours or fatigue as such. What is regulated in detail is physical risk - falls, trenching, scaffolding, cranes, traffic protection - through each province's construction regulation, Ontario Regulation 213/91 being the best known. Heat stress is handled separately as a thermal-load and hydration problem, so meeting heat guidance does not answer a fatigue duty. Fatigue on a construction site is governed by the general duty to take every reasonable precaution and by the rest minimums in that province's employment standards law.

Qui la réglemente

Construction safety is provincial. In Ontario the Ministry of Labor enforces the Occupational Health and Safety Act and the Construction Projects regulation, covering fall protection, excavation, scaffolding and traffic control; every other province has its own regulation and regulator. None contains a fatigue or hours-of-work rule, and there is no national construction safety regulator.

Vos obligations

You owe the general duty to take every reasonable precaution for worker safety, and fatigue is a recognized hazard inside it - there is no separate fatigue standard, and no safe number of hours to point to. You owe the physical-hazard duties in your province's construction regulation. And you owe that province's rest minimums, which are not uniform: in Ontario, 11 consecutive hours free each day, 8 between shifts unless the two total 13 or less, 24 consecutive hours off weekly or 48 in two, and a 30-minute break every 5 hours. Heat, where it is a hazard, is a separate duty, not a substitute.

Conséquences

Fatigue on a construction site is enforced through the general safety duty, not a fatigue offence. In Ontario that means prosecution by the Ministry of Labor under the Occupational Health and Safety Act; each other province runs its own regime with its own inspectorate and its own fines. Construction is among the most heavily enforced sectors in the country because of its fall, struck-by and equipment risks, and where fatigue contributed to one of those incidents it is treated as a hazard you knew about and did not control, which bears directly on sentencing and on whether a due diligence defense stands up. Workers' compensation claims costs follow separately.

Sanctions

There is no fatigue-specific penalty for construction; the exposure is the ordinary provincial safety maximum, and those differ. Ontario's, in force in 2026: up to $2,000,000 for a corporation (raised from $1.5 million in October 2023), $1,500,000 for a director or officer and $500,000 for any other individual (both set in 2022), plus a $500,000 minimum fine since December 2024 where a repeat offence kills or seriously injures a worker.

Antécédents

No Canadian court, coroner, investigator or regulator has published a finding linking fatigue to an incident in construction. The duty to manage fatigue still sits within the general duty in federal and provincial occupational health and safety law.

Was It Fatigue?

Soutient votre devoir général de diligence

Your duty to investigate workplace incidents under provincial OHS law does not name fatigue in construction work. Was It Fatigue? supports that investigation. A structured judgment aid, not a determination of cause.
