Ship inspectors who said they could not sleep on 24-hour shifts aboard grounded vessel lose overtime claim
Two federal marine surveyors took turns staying aboard a grounded cargo ship on 24-hour shifts, counted as 18 hours of work and 6 hours of rest. They said the rest never happened because conditions aboard were precarious and they were woken constantly, and they claimed overtime for all 24 hours each day. The federal labor board was not convinced that their duties had stopped them sleeping and put the problem down to conditions aboard the ship. It held that it was up to the surveyors to tell their manager the schedule was not working, and it dismissed the grievances.
