Réglementation

Qui la réglemente, et ce qui est attendu

Les détails réglementaires et les données de recherche de cette page sont présentés en anglais.

No Canadian law names fatigue in waste work. Your collection trucks are commercial vehicles, so drivers work to hours-of-service limits - the federal rules if you cross a border, your province's harmonized rules if you do not, each with its own exemptions - and hold commercial licenses with periodic medicals. Crews, sorters and landfill staff sit under the general duty in provincial OHS law, whether you are a municipality or a private hauler.

Qui la réglemente

Most waste employers answer to their provincial OHS regulator - in Ontario, the Ministry of Labor, Immigration, Training and Skills Development - and provincial workers' compensation boards. Haulers crossing a provincial or international border fall under the federal Hours of Service Regulations and the Canada Labor Code. Provincial licensing authorities run commercial driver medicals.

Vos obligations

Take every precaution reasonable in the circumstances for your workers, which reaches fatigue where early starts and long days make it foreseeable. Where federal or harmonized provincial hours-of-service rules apply, a driver stops at 13 hours' driving or 14 on duty, takes 8 consecutive hours off before driving again, and cannot drive once 16 hours have elapsed. Keep drivers' licensing medicals current, and accommodate a diagnosed sleep disorder to the point of undue hardship.

Conséquences

Provincial inspectors can order work stopped and prosecute, and Ontario courts must weigh legislated aggravating factors at sentencing. A failed roadside hours check puts the driver out of service on the spot and marks your carrier safety rating. Failing to accommodate a diagnosed sleep disorder runs on a separate human rights track, and claims move your workers' compensation premiums.

Sanctions

Ontario Occupational Health and Safety Act, 2026 levels: up to $2,000,000 for a corporation and $1,500,000 for a director or officer. Canada Labor Code, for federally regulated haulers: up to $1,000,000 on indictment and administrative penalties up to $250,000 per violation. Roadside hours-of-service fines are set by each province.

Tribunal finds waste truck driver's undiagnosed severe sleep apnea caused his crash; employer gets full cost relief

  • Sécurité
  • Juridique
  • Financier

A waste management truck driver lost consciousness at the wheel and crashed; afterwards he was diagnosed with severe obstructive sleep apnea and severe insomnia. The workers' compensation appeals tribunal accepted that the pre-existing sleep disorder caused the accident, noting medical advice that people with sleep apnea are two to three times more likely to have motor vehicle crashes. The worker's injuries remained compensable, but the employer was granted 100% cost relief from the provincial second injury fund because the sleep disorder, not the job, triggered the crash.
