Qui la réglemente, et ce qui est attendu

British Columbia is the one province that names fatigue in its forestry safety rules. Section 26.71.1(2)(e) of the Occupational Health and Safety Regulation says the operator of a log transporter must not operate it while impaired by fatigue - a specific duty, not a general exhortation to be safe. It is narrow. It binds the person driving the log truck, sets no hours, shift length or rest period, and does not reach fallers, silviculture crews or mill and yard workers. Quebec's forest development regulation contains no fatigue or hours provision at all, and Ontario has no forestry-specific rule, so elsewhere fatigue falls under the general safety duty.

Qui la réglemente

BC, home to Canada's largest forestry sector, regulates forestry safety through WorkSafeBC's own dedicated forestry safety rules (Part 26 of its safety regulation), backed by an industry-funded safety organization, the BC Forest Safety Council, created specifically because forestry has historically had one of the highest injury and fatality rates of any BC industry.

Vos obligations

In British Columbia a log truck operator must not drive while impaired by fatigue, and the employer must ensure its workers comply with the regulation - which in practice means being able to point to scheduling, fitness-for-duty checks and supervision, not just a policy document. Every other forestry worker - fallers, silviculture crews, mill and yard staff - is covered by the general obligation to ensure workers' health and safety, with no forestry-specific hours or rest rule in British Columbia, Ontario or Quebec. Ordinary provincial employment standards on hours, rest and overtime still apply to forestry workers, unlike farm workers.

Conséquences

Because the regulation names fatigue, an employer whose log truck operator crashes after a long shift cannot argue the hazard was unforeseeable - the rule put it in writing, which makes an order or a penalty materially easier to sustain than a general-duty case. WorkSafeBC officers can order work stopped, impose an administrative penalty on the employer without going to court, and refer serious matters for prosecution under the Workers Compensation Act, where imprisonment is available for individuals. A fatigue-related crash also drives claim costs and experience-rated premiums, and what usually decides whether a penalty follows is the scheduling and investigation record you can produce afterwards.

Sanctions

WorkSafeBC can impose an administrative penalty on an employer without prosecuting. The maximum is indexed each year and is $816,148.69 for 2026; an OHS citation is $656.48 for a first violation and $1,312.96 for a repeat within three years. Serious matters can be prosecuted under the Workers Compensation Act. In Ontario, forestry employers face that province's 2026 maximums of $2,000,000 per offence for a corporation and $1,500,000 for a director or officer.

Antécédents

No Canadian court, coroner, investigator or regulator has published a finding linking fatigue to an incident in forestry. The duty to manage fatigue still sits within the general duty in federal and provincial occupational health and safety law.

Awareness eLearning

Soutient votre devoir général de diligence

Your duty to give harvesting and silviculture crews the information, instruction and training they need, under provincial OHS law, such as s 25(2)(a) of Ontario's OHS Act, does not name fatigue. Awareness eLearning supplies fatigue and sleep content with a completion record.

Was It Fatigue?

Soutient votre devoir général de diligence

Your duty to investigate workplace incidents under provincial OHS law does not name fatigue in forestry work. Was It Fatigue? supports that investigation. A structured judgment aid, not a determination of cause.
