Réglementation

Qui la réglemente, et ce qui est attendu

Les détails réglementaires et les données de recherche de cette page sont présentés en anglais.

No Canadian rule sets fatigue requirements for longshore work. Because longshoring is federally regulated, your duty sits under Part II of the Canada Labor Code: protect the health and safety of every employee, identify and control hazards through a hazard prevention program, and investigate hazardous occurrences. The Maritime Occupational Health and Safety Regulations apply to employees loading or unloading vessels, and Part III of the Code sets hours and rest.

Qui la réglemente

Longshoring and most port operations are federally regulated. The Labor Program of Employment and Social Development Canada enforces Part II of the Canada Labor Code and the Maritime Occupational Health and Safety Regulations, which apply to employees loading or unloading vessels. Transport Canada regulates vessels and marine personnel, and the Transportation Safety Board investigates marine occurrences.

Vos obligations

Protect the health and safety of every employee at work, and identify and assess hazards, including those arising from how work is organized, in your hazard prevention program. Give each employee the information, instruction, training and supervision they need. Investigate, record and report hazardous occurrences. Meet the rest and scheduling rules of Part III of the Code as they apply to your operation, and accommodate a diagnosed sleep disorder to the point of undue hardship.

Conséquences

Labor Program officers can issue directions, stop dangerous work, impose administrative monetary penalties without going to court, and prosecute under the Canada Labor Code. Failing to accommodate a diagnosed sleep disorder runs on a separate track under the Canadian Human Rights Act, and workplace injuries move your workers' compensation assessments.

Sanctions

Canada Labor Code, 2026: fines up to $1,000,000 and up to 2 years' imprisonment on indictment, or up to $100,000 on summary conviction, plus administrative monetary penalties of up to $250,000 per violation without prosecution.

Antécédents

No Canadian court, coroner, investigator or regulator has published a finding linking fatigue to an incident in port and terminal work. Federal hazard prevention programs must cover hazards from how work is organised, which reaches round-the-clock dispatch and shift patterns.
